1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this User Policy, our Privacy Policy, and any other guidelines or rules posted within the App. If you do not agree to these terms, you may not use the App.

2. User Accounts and Registration

2.1. Eligibility

You must be at least 18 years of age or have the legal capacity to enter into a binding agreement in your jurisdiction to use this App. By registering for an account, you represent and warrant that you meet these eligibility requirements.

2.2. Account Creation

To access certain features of the App, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

2.4. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a violation of this User Policy. You may also terminate your account at any time.

3. Use of the App

3.1. Permitted Uses

The App is intended to facilitate animal rescue efforts by connecting individuals and organizations involved in animal welfare. Permitted uses include:

  • Connecting with nearby rescuers, NGOs, and animal care providers.
  • Coordinating rescue efforts through the chat feature.
  • Offering assistance or resources for animal welfare.
  • Providing updates on the status of rescued animals.

3.2. Prohibited Uses

You agree not to use the App for any unlawful, unethical, or prohibited purposes, including but not limited to:

• • Providing false or misleading information.
  • Harassing, threatening, or defaming other users.
  • Transmitting spam, junk mail, or other unsolicited communications.
  • Violating the privacy or rights of others.
  • Engaging in any activity that could harm animals or obstruct rescue efforts.
  • Impersonating another person or entity.
  • Uploading or transmitting viruses, malware, or other harmful code.
  • Attempting to gain unauthorized access to the App or other users' accounts.
  • Using the App for commercial purposes without our explicit consent.

4. Reporting Injured Animals and Coordination

4.1. Accuracy of Reports

When reporting an injured animal, you agree to provide accurate and detailed information about the animal's location, condition, and any other relevant details.

4.2. Help Button and Coordination

By clicking the "Help" button, you indicate your willingness to assist in the reported rescue effort. You understand that coordination with the reporter and other users involved may be necessary.

4.3. User Responsibility in Coordination

You are solely responsible for your interactions and coordination with other users. We do not endorse or guarantee the actions or conduct of any user. Exercise caution and good judgment when interacting with others.

5. Chat Feature

5.1. Appropriate Communication

The chat feature is provided to facilitate communication related to animal rescue efforts. You agree to use the chat feature responsibly and respectfully.

5.2. Prohibited Chat Content

You agree not to use the chat feature to transmit any content that is:

• • Illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Infringing on any intellectual property rights.
  • Containing personal information of others without their consent.
  • Misleading or fraudulent.
  • Promoting illegal activities or hate speech.

5.3. Monitoring of Chat

We reserve the right to monitor, review, and remove any chat content that violates this User Policy or is otherwise deemed inappropriate. However, we are not obligated to do so.

6. User-Generated Content

6.1. Responsibility for Content

You are solely responsible for any content you upload, post, transmit, or otherwise make available through the App ("User-Generated Content").

6.2. Rights to User-Generated Content

By submitting User-Generated Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the App and our services.

6.3. Representations and Warranties

You represent and warrant that you have all necessary rights to grant the licenses in this User Policy with respect to your User-Generated Content, and that your User-Generated Content does not violate any third-party rights or applicable laws.

7. Intellectual Property

7.1. Our Intellectual Property

The App and its original content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software) are owned by Yellow Tree or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for its intended purpose, subject to this User Policy.

7.3. Restrictions

You may not reproduce, modify, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property without our prior written consent.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE EFFECTIVENESS OF THE APP IN FACILITATING ANIMAL RESCUES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YELLOW TREE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP,ANY INTERACTIONS WITH OTHER USERS, OR ANY CONTENT AVAILABLE THROUGH THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO US FOR THE USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Yellow Tree, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• • Your use of or access to the App.
  • Your violation of this User Policy.
  • Your User-Generated Content.
  • Your interactions with other users.
  • Your violation of any third-party rights, including intellectual property rights or privacy rights.

12. Modifications to this User Policy

We reserve the right to modify or update this User Policy at any time without prior notice. Any changes will be effective immediately upon posting the revised User Policy within the App. Your continued use of the App after the posting of any changes constitutes your acceptance of the revised User Policy. It is your responsibility to review this User Policy periodically for updates.

13. Governing Law and Dispute Resolution

This User Policy shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to this User Policy or the App shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
